The Center on Juvenile and Criminal Justice found that, in California, blacks were imprisoned at 13x the rate of non-black offenders, for the same crime. The Center concluded that the only way to make sense of this disparity was to imagine two separate justice systems existed-- one for blacks, and one for everyone else. The most important factor in predicting incarceration, as a result of a marijuana-related offense, was whether the offender was black. If these offenders have all been charged with the same exact crime, why is our distribution of justice within a rule-of-law society so skewed?
