Medical errors are the third leading cause of death in the United States. Therefore, it is surprising that, at most, 20% of lawsuits end in payment. It seems that doctors and insurance companies have the advantage over injured patients and their families. Further, certain tort reform legislation capping the payable damages indicates an institutional bias against the injured parties.
